and the person or entity using the Software.
2. Definitions
Software means the WordPress plugin, add-on, code, files, documentation, updates and related materials provided by us.
License Key means a unique key used to activate access to updates, support or related services.
Website Activation means one WordPress installation or website where the License Key is activated.
Subscription means paid recurring access to updates, support or related services.
Customer means the person or entity that purchased or uses the Software.
3. Open-source components and GPL
Our Software is designed for WordPress.
Some parts of the Software may be licensed under GPL or another open-source license. Where an open-source license applies, that license governs the relevant parts of the Software.
Nothing in this Agreement is intended to limit rights that you may have under an applicable open-source license.
This Agreement governs the commercial relationship between you and us, including access to:
-
License Keys,
-
updates,
-
support,
-
customer account,
-
documentation,
-
hosted services,
-
premium features,
-
proprietary assets,
-
trademarks,
-
commercial services connected with the Software.
4. License grant
Subject to this Agreement, your order, your license plan and applicable open-source licenses, we grant you a limited right to use the Software.
The license is:
-
non-exclusive,
-
non-transferable, except where mandatory law provides otherwise,
-
limited to the number of websites or activations included in your plan,
-
subject to payment of applicable fees,
-
subject to compliance with this Agreement.
Your license plan may be described as, for example:
-
single-site license,
-
multi-site license,
-
agency license,
-
unlimited license,
-
subscription license,
-
lifetime license.
The exact scope of your license is the scope shown on the Product page, checkout page, invoice or customer account at the time of purchase.
5. What you may do
You may:
-
install and use the Software on websites covered by your license plan,
-
use the Software for your own website or client websites, if your plan allows it,
-
download available updates during the active license period,
-
access support during the active support period,
-
make backups of the Software for your own use,
-
modify open-source parts of the Software where the applicable license allows it.
6. What you may not do
Unless allowed by an applicable open-source license or by our written permission, you must not:
-
share, publish, sell, rent or transfer your License Key,
-
use one License Key beyond the purchased activation limit,
-
bypass license checks,
-
access updates or support without an active license,
-
use the Software to attack or abuse our systems,
-
use our trademarks, branding or Product names in a misleading way,
-
sell access to our updates, support, account or hosted services,
-
claim that you are the creator or official provider of our commercial services,
-
remove copyright, license or attribution notices where they are required.
These restrictions do not limit rights that cannot be restricted under an applicable open-source license.
7. License keys and activations
A valid License Key may be required to receive updates, support or access to related services.
Each license plan includes a specific number of activations.
You are responsible for managing your activations.
We may deactivate, block or limit a License Key if:
-
the license is used beyond its limit,
-
the key is shared publicly,
-
payment is refunded, reversed or disputed,
-
the license is used for fraud or abuse,
-
the Customer violates this Agreement,
-
security of our systems is at risk.
8. Updates
Updates are available during the active license or subscription period, unless stated otherwise.
Updates may include:
-
bug fixes,
-
security fixes,
-
compatibility updates,
-
improvements,
-
new features,
-
code refactoring.
We do not guarantee that every update will include new features.
We may stop supporting old versions of WordPress, PHP, WooCommerce, third-party APIs or other dependencies.
9. Support
Support is available according to your license plan.
Support may include reasonable help with:
-
bug reports,
-
license issues,
-
compatibility questions.
Support does not include:
-
custom development,
-
custom integrations,
-
fixing third-party plugins or themes,
-
hosting configuration,
-
server administration,
-
malware removal,
-
restoring broken websites,
-
work caused by custom modifications,
-
support for outdated WordPress, PHP or plugin versions,
-
guaranteed response times, unless expressly stated in your plan.
We may ask you for temporary access, logs, screenshots or technical information to investigate an issue.
You are responsible for making backups before granting access or applying fixes.
10. Subscriptions and renewals
If your license is sold as a subscription, it renews automatically according to the billing cycle shown during checkout, unless cancelled before renewal.
A subscription gives access to updates and support during the paid period.
If you cancel a subscription, you may continue to use the last downloaded version of the Software, subject to applicable licenses, but you may lose access to:
-
future updates,
-
support,
-
hosted services,
-
premium features,
-
license-based functionality,
-
customer account services connected with the active subscription.
11. Lifetime licenses
If a Product is sold as a lifetime license, “lifetime” means the lifetime of that specific Product, not the lifetime of the Customer, business, website, WordPress or any third-party service.
A lifetime license may include updates and support only for as long as the Product is actively maintained.
We may discontinue a Product if maintaining it is no longer commercially, legally or technically reasonable.
12. Beta features
We may provide beta, experimental or early-access features.
Beta features may be incomplete, unstable or changed without notice.
You should not use beta features on production websites unless you accept the risk.
13. Third-party services
The Software may integrate with third-party services, APIs, plugins or platforms.
We are not responsible for:
-
third-party service outages,
-
API changes,
-
pricing changes by third parties,
-
limits imposed by third parties,
-
account suspension by third parties,
-
changes in third-party terms,
-
loss caused by third-party systems.
You are responsible for complying with third-party terms and maintaining required third-party accounts.
14. No guarantee of business results
The Software may help automate, improve or simplify certain website or business processes.
We do not guarantee:
-
revenue,
-
sales,
-
conversions,
-
search rankings,
-
traffic,
-
leads,
-
compliance with laws specific to your business,
-
uninterrupted website operation.
You are responsible for how you use the Software on your website and in your business.
15. Backups and testing
Before installing, updating or modifying the Software, you should create a full backup of your website.
We recommend testing updates on a staging website before applying them to a production website.
We are not responsible for damage caused by the lack of backups, incompatible environments or untested updates, to the extent permitted by law.
16. Security
You must not use the Software or License Key to:
-
attack our systems,
-
reverse engineer license infrastructure,
-
bypass payment or activation systems,
-
distribute malware,
-
collect data unlawfully,
-
violate security of third-party websites.
We may suspend access if we detect security abuse or suspicious activity.
17. Intellectual property and trademarks
We retain all rights to our brand, trademarks, Product names, logos, website, documentation, commercial materials, premium services and proprietary assets.
You may not use our trademarks or branding in a way that suggests partnership, endorsement or ownership without our written permission.
18. Termination
We may terminate or suspend your access to updates, support, License Keys or related services if you breach this Agreement.
After termination:
-
your access to updates and support may end,
-
your License Key may be deactivated,
-
you must stop using our trademarks and protected commercial materials,
-
provisions that should survive termination will remain in force.
Termination does not limit rights granted to you under applicable open-source licenses.
19. Disclaimer
The Software is provided “as is” and “as available”, except where mandatory law provides otherwise.
We do not guarantee that the Software will be error-free, uninterrupted or compatible with every WordPress setup, hosting provider, plugin, theme, browser or third-party service.
20. Limitation of liability
To the maximum extent permitted by law, we are not liable for:
-
indirect damages,
-
lost profits,
-
lost revenue,
-
loss of data,
-
website downtime,
-
business interruption,
-
third-party software issues,
-
hosting issues,
-
failure to make backups,
-
incorrect installation or configuration.
Nothing in this Agreement limits liability where such limitation is not allowed by law.
21. Governing law
This Agreement is governed by Polish law.
For Business Customers, disputes will be resolved by the Polish court competent for our registered business address, unless mandatory law provides otherwise.
For Consumers, this does not limit mandatory consumer protection rights.
